1. These Terms and Conditions relate to the “WIN A BP CAR WASH!” promotion brought to you by Mars New Zealand Limited (NZ company number 117682) at 14/666 Great South Road, Ellerslie, Auckland 1051 (the Promoter).
2. This Promotion opens at 12:00:00am NZDT on Monday, 23rd November 2020 and closes at 11:59:59pm NZDT on Sunday, 17th January 2021 (Promotion Period). No entries will be accepted after this time.

Entry

3. To participate in this Promotion, you must be a New Zealand resident aged 18 years or over, and be the primary card holder of an AA Membership or AA Smartfuel account (“Eligible Entrant”).
4. The Promoter’s employees, all employees or contractors of associated companies and agencies of the Promoter and their immediate families are not eligible to participate in the Promotion.
5. To enter the Promotion you must purchase any EXTRA Bottle 64g product (“Qualifying Product”) from a participating BP Connect store (“Participating Stores”) in one transaction during the Promotion Period (“Qualifying Purchase”), and swipe your AA Membership or registered AA Smartfuel card at the time of purchase.
6. You may enter as many times as you like during the Promotion Period provided that each entry is for a separate Qualifying Purchase. Maximum one (1) entry is allowed per transaction.
7. Entrants may be required to provide proof of identity, proof of age and proof of residency to verify their entry (Proof of Identity). Identification considered suitable for verification is at the Promoter’s discretion. If an entrant/winner fails to provide Proof of Identity by the time and date stipulated by the Promoter, their entry/prize claim will be deemed invalid at the Promoter’s discretion.

Prize Draw and Prizes

8. The prize draw will take place at 12.00pm on Wednesday 20th January 2021 at the offices of Radium, Level 3, 10 Hutt Road, Lower Hutt. The first 56 complete, eligible entries drawn will each provisionally win a prize.
9. Each provisional winner will be the person listed as the primary cardholder on the winning AA Membership or AA Smartfuel account (regardless of who made the Qualifying Purchase). Neither the Promoter, BP Oil New Zealand Limited, nor Radium will be responsible in any way for any disputes arising as a result of entries being submitted by persons other than the primary card holder.
10. Entry in to this Promotion is deemed acceptance of these Terms and Conditions.
11. The Promoter reserves the right to draw additional reserve entries and record them (in order drawn) in case an invalid entry or ineligible entrant is drawn, the prize is forfeited, or if the Promoter is unable to contact the winner within seven days of the prize draw, having made reasonable attempts to do so.
12. This promotion is for BP Connect Stores only and is not applicable for 2go.

Prizes

13. There are 56 Prizes to be won. Each Prize is a single use gift voucher for a BP Ultra Clean Carwash with an RRP of up to $25. Each Prize may be used on any one car wash to the value of NZ$25 including:
    Ultra Clean – Starter $13
    Ultra Clean – Regular $17
    Ultra Clean – Super $20
    Ultra Clean – The Works $25
    Each gift voucher must be used in one (1) transaction, and any unused funds are forfeited by the winner, and cannot be refunded, exchanged, or provided in cash.
14. Prizes are valid until the date specified on the voucher or by the provider (BP), and are subject to the terms and conditions stipulated by the provider. Once awarded, the Promoter is not liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
15. The total prize pool is valued at up to NZ$1,400.
16. The prizes are not transferable, changeable or redeemable for cash.
17. In the event that the prize or any part of the prize becomes unavailable for any reason, the Promoter in its sole discretion, reserves the right to substitute the prize with a prize of equal or greater value.
18. If a winner cannot accept or take part in the prize for any reason, their prize will be void and no compensation will be payable.

Notification and Verification of Winners

19. Each provisional winner will be notified via email to their nominated email address on their AA Membership or AA Smartfuel account within two business days of the draw. In this email the winner will be sent instructions regarding how to verify their entry (including providing Proof of Identity if required) and how to redeem their prize.
20. If the winner does not respond to the Promoter’s notification email within seven (7) days of the notification email being sent by the Promoter, then their entry will be declared invalid and the Prize will be redrawn, or provided to the next reserve entrant.
21. Once the provisional prize winner is deemed by the Promoter to have complied with these Terms and Conditions of Entry, the Promoter will deliver the prize (physical voucher) by mail within 28 days of the winner’s entry being verified and accepted. The Promoter takes no responsibility for an incorrect email address being provided when entering the Promotion or during the notification and verification process.
22. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant winning a Prize. Entrants should obtain independent tax and financial advice.
23. The Promoter accepts no responsibility for late, lost, or misdirected entries.

General

24. Prizes must not be sold or used, donated or given away as part of another promotion.
25. The Promoter may refuse to award a Prize to you if, in the Promoter’s sole opinion, you have breached these Terms and Conditions or have gained an unfair advantage in participating in the Promotion.
26. The Promoter’s decision is final, and no correspondence will be entered into.
27. Any person suspected of cheating in the opinion of the Promoter through the manipulation of entry and otherwise fraudulently falsifying data or acting in any fraudulent or dishonest way, in the opinion of the Promoter, will be removed from this Promotion and damages may be sought.
28. Acceptance of a prize is deemed consent for the Promoter to use the Winner’s name, photograph and likeness for promotional and media purposes without compensation, and any copyright will vest in the Promoter. Winners agree to make themselves reasonably available for this purpose.
29. All personal information provided by entrants will be held at AA Smartfuel, Level 1, 9 Anzac Street, Takapuna, New Zealand, or at such other place as is notified to the entrant on request. Under the Privacy Act 1993, entrants have the right to access and request correction of their personal information and may do so by sending an email to contact@aasmartfuel.co.nz.
30. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian or New Zealand regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.mars.com/privacy. All entries become the property of the Promoter. For the removal of doubt, the Promoter will only use PI as set out above and in accordance with its Privacy Policy, the Promoter will not sell PI to 3rd parties.
31. The Promoter reserves the right to modify these Terms and Conditions of Entry where reasonably required.
